Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of EthosWrite Pro (the "Service"), operated by EthosWrite. By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. Accounts found to belong to ineligible users will be terminated.

You agree to notify us immediately of any unauthorised use of your account. We are not liable for losses caused by stolen or misused credentials where you failed to take reasonable security precautions.

3. Acceptable use

You agree not to use the Service to: (a) generate content that infringes third-party intellectual property; (b) submit AI-generated content as solely your own work in contexts where this is prohibited (e.g. examinations, where your institution forbids it); (c) attempt to reverse-engineer, scrape, or interfere with the Service; (d) generate content that is illegal, defamatory, or harmful in your jurisdiction.

Academic integrity is your responsibility. We provide tools that produce drafts with verified citations, but the decision to submit any output as your own work, and the manner of disclosure of AI assistance, rests with you and is governed by your institution's policies.

4. Subscriptions and payment

Paid plans are billed in advance on a monthly or annual basis through our payment processor (Paystack). Charges are processed in Ghana Cedis (GHS) regardless of the display currency.

You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

Refunds are available within 7 days of purchase, provided you have not generated substantial output. Beyond 7 days, refunds are evaluated case-by-case at our discretion.

We may change pricing with at least 30 days' notice. Existing subscriptions continue at their current rate until renewal.

5. Your content

You retain all ownership rights to the content you create, upload, or generate using the Service ("Your Content"). You grant us a limited, non-exclusive licence to store, process, and display Your Content solely as required to operate the Service.

We do not use Your Content to train AI models. We do not share Your Content with third parties except as needed to provide the Service (e.g. payment processing, email delivery) or as required by law.

You are responsible for ensuring that uploaded materials do not infringe third-party rights. Repeated copyright infringement may result in account termination.

6. Service availability

We aim to keep the Service available 24/7 but do not guarantee uninterrupted operation. Scheduled maintenance, third-party outages (academic databases, payment processors, email providers), and unforeseen failures may temporarily disrupt the Service.

We are not liable for losses arising from Service unavailability. If the Service is materially unavailable for an extended period, paid users may request a pro-rated credit.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service is error-free, that generated content is suitable for a particular purpose, or that source verification is exhaustive.

AI-generated content can contain errors. You are solely responsible for reviewing, fact-checking, and editing all output before submission to academic, professional, or legal contexts.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.

We are not liable for indirect, incidental, or consequential damages, including loss of academic standing, lost data, or lost profits.

9. Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay outstanding amounts, or use the Service in ways that pose legal or operational risk.

On termination, your access to the Service ends immediately. We will retain your data for 30 days following termination, after which it is permanently deleted unless retention is required by law.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Ghana. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of Accra, Ghana, except where mandatory consumer protection laws of your jurisdiction provide otherwise.
